Terms of service
The present document contains the conditions that will regulate the use of the given service through the website “www.CaravanToBuy.com” and constitutes an agreement between the user member of the community and Trantor Interactive Studios S.A. (herein called “CaravanToBuy”), service borrower and brand owner.
1. DESCRIPTION OF THE MANDATE AGREEMENT (BUYING CARAVANS)
CaravanToBuy facilitates through this service to its community of users the organization of operations of collective buying (herein called, “Caravans”) whose end is the purchase of a product or service in favorable conditions, in virtue of the volume generated by the growth of its users, looking for offers in the market and offering services of collaborative buying to the interested vendors.
The user who wants to create or follow an already existing caravan, with the objective of maintaining him/herself informed and in order to benefit from the conditions that they can obtain, should count with the condition of member of CaravanToBuy, which he or she obtains by completing and sending the registration form and following the steps that are communicated to him or her over email.
Through the creation or the following of a caravan, the user members fulfill a mandate for CaravanToBuy, entrusting it the proceedings of collective buying, with the end of obtaining better conditions and discount by volume in the acquisition of a product or service, conditions of the market permitting, just as described by the website.
The order processed on the part of the user members upon creating or following a caravan doesn’t suppose any contract or obligation to buy the product or service, or obligation for any payback to CaravanToBuy for the negotiations made. In any moment the user can revoke his or her mandate leaving the caravan just as it is described on the website.
CaravanToBuy, for its part, accepts the mandate of executing the shopping orders without specific agreement in regards to dates, discounts, or conditions of the operation, being able to give up its execution (“close the caravan”) in the case the that market conditions were not favorable for itself, notifying the followers of the caravan of the close.
2. PROPOSAL AND ACCEPTANCE/SUCCESS OF DEALS
When a vendor makes an attractive offer and there are a sufficient numbers of followers in the caravan, CaravanToBuy will move the buying conditions “wholesale” agreed upon by means of a “Deal Proposal”, offering the followers the possibility to adhere themselves to the same.
The deal proposal will have a limited capacity, so that a determined duration will be fixed in every case by CaravanToBuy, attending to the established agreements with the provider of the service or product, which will be informed through the website.
This duration could vary and finalize in advance in the case that the conditions of the collective buying are realized, or if the vendor’s stock for the offer runs out.
The acceptance of the deal supposes the acceptance of the proposed conditions and the execution of the buying operation on the part of the user directly with the vendor that executes the offer, always conditioned to the possible final execution of the collective buying operation.
The final execution of the collective buying offer (“departure of the caravan”) is conditioned so that it reaches a minimum number of interested parties, published by CaravanToBuy previously in the conditions of the caravan in relation with the established agreements with the vendor of the service or product.
In the case that the caravan does not achieve the minimum number of followers, the operation will be cancelled without any charge to the user.
3. PREAUTHORIZATION AND PAYMENT
The user member will execute payment through credit card, transferring the amount of his or her buy to CaravanToBuy, that will manage the total payment of the collective buy according to the agreed upon conditions with the vendor.
In the moment of the buy, CaravanToBuy will execute a “pre-authorization” of payment with the user’s credit card. If the collective buying operation is finally executed, the said transaction will be converted in the cash payment of the buy. In the opposite case, there will be no charge made to the user’s credit card.
4. CONDITIONS FOR BUYING AND SELLING
The buying and selling of product is produced in direct relation between the vendor that executes the offer and the member user that executes the buy.
The own conditions of the buy and sell, such as delivery, guarantees and returns are specific to every buying operation, and they will vary according to the type of product or the vendor who offers it.
CaravanToBuy will publish the specific conditions of every operation in every caravan, as part of the trade proposal when it is produced.
5. OTHER CONDITIONS FOR USE
The use of the website www.caravantobuy.com is limited to those 18 or older, or minors always accompanied by an adult.
Trantor Interactive Studios S.A., owner of the brand CaravanToBuy, is an private Spanish company with residence in Calle Manuel Pombo Angulo 18, 3º 5. 28050 Madrid, registered in the Registro Mercantil de Madrid, in the volume 10190, page 1, page number. M-162547, with CIF number A-81291460.
CaravanToBuy reserves the right to modify, in any moment, the presentation and configuration of the website, as is presented in the conditions of use.
In the case that any clause of the present conditions is declared null, the rest of the clauses will continue to be valid and they will be performed having in account the will of the parties and the same purpose of the present conditions.
